1. Introduction & Acceptance

Welcome to VĀIRAA Cosmetics (“we,” “us,” or “our”). These Terms and Conditions govern your access to and use of our website, product catalogue, online ordering systems, and customer services. By accessing, browsing, or purchasing products through this platform, you agree to be bound by these Terms and our related policies, including our Privacy Policy, Cancellation & Refund Policy, and Shipping & Delivery Policy.

2. Eligibility to Contract

Use of this website is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are “incompetent to contract,” including minors, are not eligible to register or make purchases unless supervised by a parent or legal guardian.

3. Product Information, Shade Accuracy & Pricing

• Product Descriptions: We take every effort to showcase our lipsticks, shade pigments, casing materials, and clean formulations as accurately as possible. However, individual screen display calibrations, skin undertones, and natural lighting may cause slight shade variations.
• Pricing: All prices listed on this website are in Indian Rupees (INR - ₹) and are inclusive of applicable Goods and Services Tax (GST).
• Launch Pricing: Our debut Matte Muse lipstick collection is offered at the official launch price of ₹399 per 5g bullet. We reserve the right to revise prices or promotional offers at any time prior to order confirmation.
• Errors: In the event that a product is mistakenly listed at an incorrect price due to a typographical error, we reserve the right to cancel or decline any order placed for that product.

4. Electronic Payments & Payment Gateway Terms

We offer secure digital payment processing to ensure seamless checkouts across India.

You agree to provide valid, accurate payment account details when placing an order. In the case of payment failure or fraudulent alerts from the payment gateway, we reserve the right to halt processing until valid verification is received.

5. Order Acceptance, Dispatch & Fulfilment

Receipt of an order confirmation email or SMS does not signify final acceptance of your order. We reserve the right to accept or decline your order for reasons including inventory constraints, courier non-serviceability, or suspicious payment patterns.

Orders are processed and dispatched within 24 to 48 business hours from our atelier. You will receive an Air Waybill (AWB) number and live tracking link once handed over to our courier partner.

6. Hygiene Policy, Returns & Cancellations

Due to strict personal cosmetic hygiene and health safety guidelines, opened, swatched, or used lipsticks cannot be returned. Orders may be cancelled before shipment by contacting customer care. If your package arrives defective, damaged, or incorrect, notify us within 48 hours for an immediate complimentary replacement or refund. 7. Intellectual Property Rights

All content on this website, including but not limited to the brand name “VĀIRAA,” lotus crest emblem, product shade names, copywriting, photographs, illustrations, and design systems, are the exclusive intellectual property of VĀIRAA Cosmetics. No part of this site may be reproduced, duplicated, copied, or sold without express written consent.

8. Limitation of Liability & Disclaimer of Warranties

Our products are formulated with botanical oils (coconut oil, sweet almond oil, shea butter, cocoa butter, vitamin E) and are 100% free from parabens, mineral oils, and harmful toxins. While our formulas undergo quality checks, we advise performing a 24-hour patch test before full application if you have sensitive skin or known botanical allergies.

To the maximum extent permitted by applicable law, VĀIRAA Cosmetics shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our products or website.

9. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by, interpreted, and construed in accordance with the laws of the Republic of India. Any disputes arising in connection with these Terms or orders placed on this platform shall be subject to the exclusive jurisdiction of the competent courts in Tamil Nadu, India.
